Terms of service
General Terms and Conditions (GTC)
This is a courtesy translation. The German version is legally binding.
1. Scope
These General Terms and Conditions (GTC) apply to all orders placed by consumers (Section 13 of the German Civil Code, BGB) via the online shop of vaerm GmbH, Franz-Klühs-Str. 7, 10969 Berlin, Germany, e-mail: support@vaerm.de. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 BGB).
2. Contracting party, conclusion of contract
The purchase contract is concluded with vaerm GmbH. The presentation of the products in the online shop does not constitute a legally binding offer but a non-binding online catalogue. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order. By clicking the order button you submit a binding offer for the goods contained in the shopping cart. Confirmation of receipt of your order is sent by e-mail immediately after submission. The purchase contract is concluded as soon as we accept your order by a declaration of acceptance or by delivering the goods.
3. Contract language, storage of the contract text
The language available for concluding the contract is German. Translations of these GTC into other languages are for information only; in case of doubt the German version prevails. We store the contract text and send you the order data and our GTC by e-mail. You can view your past orders in your customer account if you have created one.
4. Delivery conditions
Shipping costs may be charged in addition to the stated product prices. Details of the shipping costs can be found in the offers and in our shipping policy. We deliver within Germany, the EU and to Switzerland unless otherwise stated for the respective product. Collection in person is not possible unless expressly offered.
5. Payment
The following payment methods are generally available in our shop: credit card (Visa, MasterCard, Amex), PayPal, Shopify Payments (e.g. Apple Pay, Google Pay, Klarna, Sofort) and, depending on the country, further local payment methods. Payment is made immediately upon completion of the order. In the event of late payment we reserve the right to charge reminder fees.
6. Retention of title
The goods remain our property until full payment has been received.
7. Right of withdrawal and return costs
Consumers are entitled to the statutory right of withdrawal under Section 355 BGB; in addition, we grant a withdrawal period of 30 days. Details can be found in our withdrawal policy. The direct cost of returning the goods is borne by the customer. For returns from Germany we offer a discounted return label via our returns portal; for returns from all other countries the customer sends the goods back themselves and at their own expense.
8. Transport damage
If goods are delivered with obvious transport damage, please report such defects to the carrier immediately if possible and contact us without delay. Failure to make a complaint or to contact us has no effect on your statutory claims and their enforcement, but helps us to assert our own claims against the carrier or the transport insurance.
9. Warranty and guarantees
The statutory warranty rights apply. Any additional guarantees by manufacturers or by us apply only if they are expressly stated in the respective product offer.
10. Liability
We are liable without limitation for intentional and grossly negligent breaches of duty and for damage resulting from injury to life, body or health. In the case of slightly negligent breaches of duty, we are liable only for damage resulting from the breach of essential contractual obligations (cardinal obligations), i.e. obligations whose fulfilment is essential for the proper performance of the contract and on whose observance you may regularly rely. In this case, however, liability is limited to the foreseeable damage typical of the contract at the time of conclusion. Any further liability is excluded.
11. Dispute resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
12. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory provisions of the state in which you have your habitual residence remain unaffected. Should individual provisions of this contract be invalid, the remainder of the contract remains valid. The statutory provisions apply in place of the invalid provision.
